SHOTSBYJCMILL Terms of Service

Effective Date: July 1st, 2026

Welcome to SHOTSBYJCMILL. By booking or using our services, you agree to the following terms and conditions:

1. Booking and Payments

  • A non-refundable deposit is required to secure your session.

  • For standard sessions, full payment must be made at the end of the shoot before client gallery delivery.

  • For events and larger-scale shoots (e.g., corporate events, multi-location sessions), full payment is due on the day of the event, prior to the event's start time.

2. Cancellation and Rescheduling

  • Deposits are non-refundable.

  • Rescheduling requests must be made at least 48 hours in advance. Requests made within 48 hours may result in forfeiting the deposit or additional charges.

  • Deposits can only be transferred once. If the shoot needs to be rescheduled again, the deposit will be forfeited.

3. Service Scope

  • Photography services are based in Atlanta, GA, with travel available for destination sessions and projects by arrangement.

  • Services include portraits, celebrity shoots, branding, and business photography.

  • Larger-scale shoots, such as corporate events or multi-location sessions, include consultations.

4. Image Delivery, Gallery Access, and Retention

  • Final images will be delivered digitally within the agreed timeframe via an online gallery.

  • Gallery access windows will be communicated at the time of delivery. Access is not indefinite; clients are encouraged to download and back up their images promptly.

  • Should a gallery's access window close, reactivation may be available for a fee. Contact SHOTSBYJCMILL to arrange reactivation.

  • SHOTSBYJCMILL retains original/raw files for a period of 6 months following delivery, after which files may be archived or deleted. If a reshoot or file recovery is needed, please contact us as soon as possible within this window.

  • SHOTSBYJCMILL retains the right to use photos for portfolio and promotional purposes unless otherwise agreed upon in writing.

5. Model and Property Releases

  • For branding, commercial, and organizational shoots, SHOTSBYJCMILL will assist in coordinating any necessary model releases from individuals appearing in the images (other than the client themselves) and property/location releases for any private venues used.

  • The client remains responsible for identifying all individuals and locations requiring a release and will be kept informed throughout this process. Final responsibility for confirming that all required releases have been properly executed rests with the client, unless otherwise agreed in writing.

  • SHOTSBYJCMILL is not liable for claims arising from a failure to secure required releases where the client has been notified of the requirement.

6. Minors and Family Sessions

  • For sessions involving minors, a parent or legal guardian must be present or have provided prior written consent, and must sign on behalf of any minor client.

  • By booking a family or portrait session involving minors, the parent or guardian agrees to these Terms on the minor's behalf, including the image usage and portfolio/promotional rights outlined in Section 4.

  • Parents/guardians may opt out of having images featuring their minor child(ren) used on SHOTSBYJCMILL's social media or public marketing channels by notifying SHOTSBYJCMILL in writing prior to or at the time of the session. Absent such notice, standard portfolio/promotional usage rights apply.

7. Client Conduct

  • Clients are expected to arrive on time for sessions.

  • SHOTSBYJCMILL reserves the right to refuse service for inappropriate behavior.

8. Liability and Force Majeure

  • SHOTSBYJCMILL is not responsible for circumstances beyond its reasonable control, including but not limited to severe weather, illness or medical emergencies, natural disasters, venue issues, or government restrictions.

  • In the event a shoot is affected by any of the above, SHOTSBYJCMILL will notify the client as soon as reasonably possible — as soon as the event occurs, upon return to full health, or as soon as practicable given the circumstances — to coordinate rescheduling or next steps.

  • Liability is limited to the return of all payments received, including deposits.

9. Copyright and Usage Rights

  • All images are copyrighted and remain the property of SHOTSBYJCMILL.

  • Clients receive personal usage rights for images delivered to them.

  • Commercial use of any image (including but not limited to advertising, product packaging, resale, or third-party licensing) requires prior written consent from SHOTSBYJCMILL and may be subject to an additional licensing fee. Please contact SHOTSBYJCMILL to discuss commercial licensing options before using images commercially.

10. Governing Law and Disputes

  • These Terms are governed by the laws of the State of Georgia.

  • Any disputes arising from these Terms or services rendered will first be addressed through good-faith direct communication between the parties. If unresolved, disputes may be brought in the appropriate courts of Fulton County, Georgia, or resolved through mediation as mutually agreed.
